The Low Demand Literacy Space — Membership Terms

1. Who These Terms Are Between

These Terms and Conditions ("Terms") form an agreement between you ("you," "member," or "your") and Nestwise at Home, a trading name of Nestwise Education (ABN 38 103 322 337) ("we," "us," "our," or "Nestwise at Home").

By joining the Low Demand Literacy Space ("the Membership"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not join the Membership.

2. What the Membership Includes

As a member, you will receive access to:

  • Direct, async written Q&A access to Amity within the membership community space
  • Monthly live Q&A calls
  • A growing resource library of videos, printable games, activity guides, and tools
  • Full access to the Teach Your Child to Read course, the Print-Rich Home workshop, and Playful Phonics with Magnetic Tiles

The specific content, format, and features of the Membership may evolve over time as we continue to develop and improve it. We will always aim to maintain or improve the overall value of your Membership, and we will let you know of any material changes.

3. Membership Fees and Billing

The Membership operates on a recurring monthly subscription basis. Your nominated payment method will be billed automatically each month on the date that corresponds to your original sign-up date, until you cancel.

Whatever monthly rate applies to you at the time you join is the rate you keep, for as long as you remain a continuous, active member, regardless of any pricing changes we make for new members after you. If you cancel your membership, you are not guaranteed your previous rate if you choose to rejoin at a later date. Rejoining members pay whatever rate applies to new members at the time they rejoin.

We reserve the right to change our pricing for new members at any time, and for existing members with reasonable advance notice. We will provide at least 30 days' written notice, typically by email, before any price change takes effect for existing members. This does not affect the rate-lock guarantee described above, which continues to apply to any member for as long as they remain a continuous member, regardless of any general pricing changes made after they joined.

4. Cancellation

You may cancel your Membership at any time. There is no lock-in contract and no minimum commitment period.

When you cancel, your access to the Membership will continue until the end of your current paid billing period. You will not be charged again after that point, and your access will end at the conclusion of that billing period.

5. Refunds

All membership fees are non-refundable. Because the Membership provides ongoing access to content, community, and personal support rather than a one-off product, we do not offer refunds for partial months, unused access, or change of mind, except where required by Australian Consumer Law or other applicable law.

Nothing in this section limits any non-excludable rights you may have under the Australian Consumer Law or other consumer protection laws that apply to you.

6. Access and Conduct

Your Membership is personal to you and is not to be shared, transferred, or resold. Each Membership is intended for use by one family.

We ask that all members engage with the community space, live calls, and Q&A access respectfully and in the spirit in which this Membership was built: warm, supportive, and judgement-free. We reserve the right to remove any member from the community space, without refund, if their conduct is abusive, harassing, or otherwise inconsistent with maintaining a safe and supportive space for other members and for Amity.

7. Suspension and Termination

In addition to the conduct-related removal described in Section 6, we may suspend or terminate your access to the Membership, with reasonable notice where practical, if your payment fails and is not resolved within a reasonable period, you breach these Terms in a way that is not minor or technical, or we reasonably believe your continued access poses a risk to us, to Amity, or to other members.

If your payment fails, we will attempt to notify you and may make reasonable attempts to process payment again. If payment cannot be successfully processed within 7 days, we may pause or end your access to the Membership until payment is resolved.

8. Service Availability

We do our best to ensure the Membership, including the community space, content library, and scheduled live calls, is available and runs as planned. However, the Membership relies on third-party platforms, currently Kajabi, and we are not responsible for outages, downtime, or technical issues caused by those platforms.

From time to time, Amity's ability to deliver content or live calls on the usual schedule may be affected by illness, family circumstances, or other matters reasonably outside her control. Where this happens, we will let members know as soon as practical and will reschedule or adjust where possible. Occasional, reasonable disruption of this kind does not entitle members to a refund or credit, and this will be considered case by case upon request.

9. Content, Ownership, and Sharing

All content provided as part of the Membership, including but not limited to videos, written materials, resources, templates, podcast episodes, live call recordings, and personal Q&A responses, is the intellectual property of Nestwise at Home and is protected by copyright.

Your Membership gives you a personal, non-transferable licence to access and use this content for your own family's homeschooling purposes. You may not:

  • Share your login or access with anyone outside your household
  • Copy, screenshot, record, or redistribute Membership content, including personal Q&A responses, outside the Membership space
  • Resell, repurpose, or use Membership content for any commercial purpose

We understand members may want to share their own experience of being in the Membership, for example, a general testimonial or a photo of an activity you tried at home. This is welcomed. What is not permitted is sharing the underlying content, materials, or personal responses themselves.

When you post in the community space, including questions, comments, photos, or other content, you retain ownership of what you share. By posting, you give us permission to display your post within the Membership so that other members can see and benefit from it, for example, where your question and Amity's response are visible to other members as part of the Q&A loop.

10. Educational Guidance, Not Professional Advice

Amity is a qualified literacy specialist, and all content and guidance provided through the Membership, including general content, live calls, and personal Q&A responses, is grounded in her knowledge and experience. However, everything provided through the Membership is general education, information, and support. None of it is, or is intended to be, a professional assessment, diagnosis, intervention, treatment plan, or individualised education plan for your child.

This applies equally to personal Q&A responses. When Amity responds to a question about your specific child, that response is offered as informed general guidance based only on what you have chosen to share. It is not a clinical or diagnostic opinion, it is not based on direct observation, testing, or assessment of your child, and it cannot account for information you have not provided or are not aware of yourself. A Q&A response carries the same status as any other general content in the Membership: helpful, informed guidance for you to weigh, not a directive for you to follow.

You remain, at all times, the parent and primary decision-maker for your child's education, development, and wellbeing. Any decision you make about your child's learning, including any decision made after receiving guidance through the Membership, is your decision, made at your discretion and your own risk. We do not accept responsibility for outcomes that result from choices you make based on Membership content.

We do not guarantee any specific outcome, result, reading level, developmental milestone, or rate of progress for any child as a result of participating in the Membership. Children develop at different rates and in different ways, and no educational guidance, however well informed, can promise a particular result for an individual child.

If you have concerns about your child's learning, development, behaviour, or wellbeing, including anything that feels urgent or out of the ordinary, please seek the advice of an appropriately qualified professional, such as a speech pathologist, psychologist, paediatrician, GP, or educational psychologist. The Membership is not equipped to identify, assess, or respond to welfare or medical concerns, and Amity may decline to respond to questions that fall outside the scope of general literacy education and may instead recommend you seek professional support.

By joining the Membership, you actively acknowledge and agree that any guidance provided to you, including personal Q&A responses and live call discussion, is general in nature, is based solely on the information you choose to share, and does not constitute a professional assessment, diagnosis, or individualised plan for your child. You acknowledge that you remain the primary decision-maker for your child's education and wellbeing at all times. This acknowledgment is confirmed separately by you at the time of signup.

Throughout our marketing and the Membership itself, we use language such as "personal," "specific," "tailored," and "real" to describe the warmth, relevance, and individual attention you can expect from this Membership, in contrast to generic, one-size-fits-all content. This language describes the style and care with which guidance is delivered. It does not mean, and should not be understood to mean, that any response constitutes an individualised clinical assessment, diagnosis, or professional treatment plan for your child. The nature and limits of the guidance provided are set out in this Section 10.

11. Limitation of Liability

To the maximum extent permitted by law, Nestwise at Home excludes all liability for any loss or damage, however caused, including by negligence, arising from or in connection with your reliance on any content, guidance, or personal Q&A response provided through the Membership, including any decision you make about your child's education or wellbeing as a result of that content or guidance.

To the maximum extent permitted by law, Nestwise at Home is not liable for any indirect, incidental, special, or consequential loss arising from your use of the Membership. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

12. Changes to These Terms

We may update these Terms from time to time, for example as the Membership grows and evolves. Where changes are material, we will let members know by email with reasonable notice before the changes take effect. Your continued membership after that point will be taken as your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

14. Your Privacy

We collect personal information from you in order to provide the Membership, communicate with you, and personalise the support and guidance you receive. This includes information you give us directly, such as your name, email address, location, and the details you share through our "get to know you" form, including information about your homeschool and your children, as well as information generated through your use of the Membership, such as your posts and questions in the community space.

Some of the information you share, particularly about your children, may include sensitive information, such as information about a child's neurodivergence, learning needs, or developmental stage. You provide this information voluntarily and on the basis that it will be used only to help us personalise the support and guidance we offer to you, as described in these Terms.

Your information is currently stored and processed through Kajabi, our membership and payment platform, and Google Forms, used for our "get to know you" intake form. We do not sell your personal information, and we do not share it with any third party outside these platforms, except where required by law.

We retain your information for as long as you remain a member, and for a reasonable period afterward in case you choose to rejoin or as required for our business and legal record-keeping. You may ask us, at any time, what personal information we hold about you, ask us to correct it, or ask us to delete it, by emailing [email protected]. We will respond to reasonable requests within a reasonable timeframe, noting that some information may need to be retained where required by law.

The Membership is intended for adult parents and carers. It is not directed at, and is not intended to be accessed directly by, children. Where you share information about your child with us, you do so as their parent or carer, and you confirm you have the authority to share that information with us for the purposes described in these Terms.

15. General

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue in full force and effect. These Terms, together with any policies referred to in them, set out the entire agreement between you and us regarding the Membership, and replace any prior discussions or understandings on this topic.
